Is Your Online Business Internet Law Compliant?

 This article concerns your legal obligations and rights concerning the maintenance of a mailing list and in particular the sending of commercial email. It is a tricky subject. You might even think that it is something which does not affect you, but if you have seen what is currently happening on the internet, and what is going to happen in the not so distant future, then you will also know that to ignore these developments would be to put yourself at unnecessary risk.
In the United States of America, the Federal Trade Commission has already prosecuted a number of well known internet marketers for non compliance of internet law, and these actions are bound to spread worldwide.
In January 2004, the Draconian California email laws came into force which immediately started to shake up the online business community, and in early December 2003 similar laws were introduced in England and elsewhere in the European Union.
Does any of this mean anything to you so far? If it doesn't then we've got news for you. Saying that you know nothing about these laws will not protect you. Just as with all other types of law, ignorance is no defence.
Here are a couple of questions to ponder:
Do you have your own website, whether personal or commercial?
Do you operate an online magazine (ezine) or mailing list?
Do you have a list of contacts that you send messages to periodically?
If you manage a website do you:
* have a Privacy Policy in place?
* have a Terms of Use document in place?
* have a Purchase Agreement in place for every item you sell (for commercial sites)?
* have an Affiliate Agreement in place (if you run an Affiliate Programme)?
If you operate an ezine or mailing list of any kind:
* do you send messages containing advertisements, whether promoting your products or services, or those of third parties?
If yes, do you have the direct consent of your subscribers to send such messages?
I realise that is a lot to be thinking about. But you should be thinking about it, because the world of internet commerce is going through a BIG shake-up. The authorities say it is all to do with clamping down on spammers and scamsters, but if you are otherwise honest and scrupulous in your dealings you could still fall foul of these new laws simply by not being seen to comply. So what can you do to comply?
You can start off by taking a serious look at the way you run your mailing list. Are you absolutely sure that each and every subscriber has given their direct consent for you to send them commercial email messages? What do we mean by direct consent?
Let's tackle this by looking at what direct consent is NOT.
For example, you operate a mailing list for subscribers who want to know about updates to your site and/or products. On occasion you send these people a message advertising a product or service for which you are an affiliate.
Just because these people are on your mailing list does not give you the express right to send them an advertisement. What you would need to do would be to make it clear, at the time they subscribe, that they will be receiving commercial messages from time to time. And having your subscribers simply click a check box does NOT amount to them giving their direct consent.
You may run an ezine that includes advertisements. But have the subscribers given their direct consent for you to send them ads from third parties? Yes, it really is getting that nit-picky and you will have to work out how to go about getting their consent. Perhaps the most efficient way would be to adopt a double optin policy and be totally upfront from the outset regarding the kind of material you are likely to be sending your subscribers.
As for your website, you will need more detailed documents in place in order to cover yourself legally. As stated earlier, these MUST include a Privacy Policy and a Terms of Use to cover you for the use and content of your site, whether it is just a simple personal home page or a full blooded online store.
If you run a commercial site, you will need a Purchase Agreement for every separate product or service you offer, in addition to the other two pages already mentioned.

In the world of network marketing, how can someone acquire that type of personality, how can someone become a magnetic sponsor, and develop a large base of customers using magnetic like attributes?

Would you rather buy from a salesperson who insists that his/her drill is the best tool for what you want to do? I wouldn't. Because I don't like to be sold, and I don't like people to pitch their sales number on me.
Would you rather buy from a person who gave you free information or inexpensive information on how to properly operate, and get the best results from that tool, and who did not try to pitch a drill on you?
Again, if you are like me, you would buy from a person who first took the time to educate you on how to make that hole proper. In your mind, this person is an expert in his/her field, he/she knows what he/she is talking about. So you sell yourself on buying that drill from him/her.
This is what many network marketers keep doing, they keep pitching their opportunities on their family, friends, relatives, and get all hyped up on the net, on their ads, and every one they encounter. But guess what? People do not care about your business opportunity, what they care about is a solution to their problems. In other words, you did not buy a business opportunity (drill) because you wanted one. You wanted a solution (hole) for more free time to spend with your family, be your own boss, earn a living online, or get rich, etc..
So, what you need to do instead of pitching your opportunity to your prospects, is to sell them inexpensive or give away free information that shows how to solve problems - how to drill that "hole."
If you can show them how to make that "hole", your prospects will come to the conclusion on their own without you pounding hard on them that they need a drill from you. Why? Because you gave them free knowledge or inexpensive information on how to accomplish their goal, and therefore earning their trust in you.

New Google Blog Search is Great Marketing News for Business Podcasts, Blogs and RSS Feed Publishers

 Google just introduced Blog Search in beta yesterday. This new search function allows for you to search the internet for Blogs, Podcasts and RSS feeds. You simply type in your keywords and it will show you results that have come from these sources.
The results they display are not showing any preferences to Blogs that are published on Blogger. We are seeing results for all Blogging platforms. Actually Google Blog Search is not just looking at Blogs. They are looking for any RSS feed, which might be from a Blog, Podcast, or any other XML feed. It appears that the search tool is pretty responsive and we are seeing results show up in a matter of hours after a new post is made to the RSS Blog and Podcast Feed. This is another way that you can create online visibility for your business.
The organic results are sorted by relevancy, but you have the option to sort them by date as well. This is especially nice if you want to locate the latest post for a fast breaking news topic and want to find it quickly in the blogosphere. The other thing that Google has done is to try to eliminate some of the "noise" and Spam of the blogosphere. They are looking at high quality Blogs and show them at the top of the page under what is called "Related Blogs". This is prime real estate for your Blog to be listed in.
As an example: Go to the new Google Blog search ( http://blogsearch.google.com ) and type in podcasting tips. The results that are shown at the top 2 of the 3 Related Blogs happen to be authored by me. You will also see over 1600 results and we have several additional results on the front page. Google currently does not support a manual submission for your Blog feed. I think this is smart, since it keeps the unethical people out of the picture. If you are Blogging or Podcasting properly and following best practices; your feed will be found by Google. Make sure that you are also following best practices for pinging after your feed is updated. This will ensure that your feed is updated by Google.
It looks like Google started to index Blogs, Podcasts and RSS feeds in June of 2005. They are currently not showing posts that were made previous to this. They may change this in the future. Google has found a way to somewhat keep the black hat SEO and unethical Bloggers out of the results. We can all celebrate this; because this means quality and relevant results for searchers.
Podcasters should also take note that individual podcast shows are also being listed in the results. This is a great way for users find your podcasts and individual podcast shows, based upon specific topics and content.

13 Steps to Successful Blogging

Blogs can be a very marketable and very profitable tool if used correctly. Profiting from blogs is just a matter of grabbing the attention of an audience and not doing any actual salesmen selling. In this article you will learn the 13 most essential steps to successful blogging.

1) Where to start?
You should begin your blog with a free blog hosting service such as Journal Home. I don't say that because I'm the owner, but a free blog host is very rewarding for a new blog. Starting with a free blog hosting service allows you to begin blogging instantly without having any advance knowledge of scripts, hosting, or programming. It allows you to build an audience and buzz for your blog. It allows you to focus on your content and not the internal maintenance of the blog. The best benefit of starting with a free service, is in the case your blog doesn't become successful you do not lose any money or are you left holding the bill. The great thing about a blog is that they are organized in chronological order, your latest entry is displayed first. When your blog traffic grows greatly and you are ready to upgrade to your own domain then you can simply make your last blog entry the announcement of your "move". Simply add a last entry stating that your blog has "moved" and type the new blog URL address. Which directs visitors to your new blog site, keeping your following, without a major inconvenience to anyone. Upgrade as you need to...but only when you need to!

3) Update Daily (nothing less)
This step is a must and not a suggestion. Updating your blog daily not only keeps your blog more interesting to readers, but it also gives your blog fresh content on a day to day making it more appealing to search engines. Not updating your blog on an occasional holiday or one day here and there is understandable to most, but missing days at a time or weeks is unacceptable and will most likely result in your blog being unsuccessful. Though, I am seeing a growing trend of successful blogs that are not being updated daily, but they are successful and have a stable audience who continue to visit their blog daily. The best way to accomplish this is to set aside 1-2 hours a day for tending to your blog and adding new entries. It may even be wise to schedule a set time which you dedicate to your blog each day. Give yourself work hours and treat your blog as a job, what happens if you don't come to work for days or weeks...you lose money or worse you get fired! Same applies here...if you don't update your blog for days or weeks you'll lose visitors.

4) Traffic
It's no secret. You must have traffic to profit from blogs. There are numerous ways to build traffic. Paid advertising, free advertising, viral marketing, search engine marketing, RSS/XML feeds, and word-of-mouth. You should always use your blog URL address in the signature of your email, forum discussions, message boards, or any other communication media. You should submit your blog URL address to search engines and blog directories. You should submit your RSS/XML URL feed to blog ping services like Technorati, Ping-O-Matic, and Blogdigger. You should confidently share your blog with family, friends, co-workers, associates, and business professionals when it relates. Many blogs can be considered as a collection of articles, for this purpose you should submit your blog entries (those that are valuable and lengthy articles) to content syndicators like GoArticles.com or ArticleCity.com. Once submitted your articles can be picked up and published by others. The trick is to make sure you include your Blog URL address in the "About the Author" passage.
